Bedford Road, Lower Stondon

ARP were appointed following the refusal of a larger scheme on the site at the edge of North Herts. A site allocated in the emerging North Herts Local Plan, yet unpopular with local residents in Central Bedfordshire, which neighbours the site.

Our role has included:

  • Instructing leading planning counsel and advising on the prospects of success at appeal;
  • Coordinating the appointment of a new consultant team including architects, landscape architects and heritage specialist;
  • Preparing a comprehensive response to the previous reasons for refusal, most notably in respect of design and the impact of the scheme on the setting of the neighbouring grade II* listed building;
  • Advising on S106 obligations including those which have cross boundary effects. In particular our role has involved negotiation with officers from North Herts, Central Beds and Herts County to resolve where school funding should be applied.



Following the decision by the Planning Committee to defer the application in June 2019, an appeal was lodged under PINS new fast track procedures on the grounds of non-determination. The application was re-considered by the committee in July 2019 where members resolved that had they had the appeal not been lodged they would have approved the application in accord with the officer’s recommendation.  The appeal is due to be considered at Inquiry in October 2019 but in the meantime a duplicate application has been submitted in the hope that the Inquiry can be avoided.
